1. Brokerage Disclosure (MA & CT Requirement)

Blue Real Estate LLC is a licensed real estate brokerage operating in Massachusetts and/or Connecticut.

We comply with:

• Massachusetts Agency Disclosure Law (254 CMR 3.00)
• Connecticut Agency Disclosure Requirements (CGS §20-325d)

Agency relationships (Seller’s Agent, Buyer’s Agent, Dual Agent) will be disclosed in writing as required by law.

2. Services Provided

• Buyer representation
• Seller listing services
• Rental and landlord representation
• Property marketing and consulting

3. Fair Housing Compliance

We strictly adhere to:

• The Fair Housing Act (42 U.S.C. §3601-3619)
• Massachusetts Fair Housing Laws
• Connecticut Fair Housing Laws

We do not discriminate based on:

• Race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any protected class.

4. No Guarantee of Results

We do not guarantee:

• Sale price
• Time on market
• Rental occupancy timelines

Market conditions and third-party factors influence outcomes.

5. Client Responsibilities

Clients agree to:

• Provide accurate and complete information
• Review all contracts carefully
• Seek legal and tax advice where appropriate
• Fulfill contractual obligations

6. Electronic Communications & Consent

In compliance with federal and state law (including E-SIGN Act):

You consent to receive communications via:

• Email
• Phone
• SMS/Text messaging

You may opt out of marketing communications at any time.

7. Dual Agency Disclosure (Critical in MA & CT)

In certain transactions, we may represent both buyer and seller.

• This will only occur with informed written consent
• We will remain neutral and cannot advocate fully for either party

8. Escrow & Handling of Funds

All deposits and escrow funds will be handled in accordance with:

• Massachusetts real estate escrow regulations
• Connecticut real estate escrow laws

Funds will be held in properly designated escrow accounts.

9. Third-Party Services Disclaimer

We may recommend vendors; however:

• We do not guarantee their performance
• Clients are responsible for independent due diligence

10. Limitation of Liability

To the fullest extent permitted by MA and CT law:

• We are not liable for indirect or consequential damages
• Liability is limited to the scope of services provided

11. Indemnification

Clients agree to indemnify Blue Real Estate LLC against claims arising from:

• Misrepresentation
• Breach of agreements
• Failure to disclose material facts

12. Record Retention

We maintain transaction records in compliance with:

• Massachusetts recordkeeping laws
• Connecticut real estate record retention requirements

13. Governing Law

This agreement shall be governed by:

• The laws of the Commonwealth of Massachusetts, or
• The laws of the State of Connecticut, depending on transaction location

14. Termination of Services

We reserve the right to terminate services if:

• Legal or ethical violations occur
• Client cooperation is not maintained
• Misrepresentation is discovered

15. SMS Communications Disclosure
